This Privacy Notice explains how Neuroscale LLC (“Neuroscale,” “we,” “us,” or “our”) collects, uses, and shares your personal information when you use Neuroscale services, and how you can exercise your privacy rights.
This Privacy Notice applies to the personal information we process in connection with our websites, neuroscale.ai and arbi.ai (each referred to as a “Site”). Collectively, we refer to these Sites and the associated services as “Neuroscale Services”.
An Important Note: This Privacy Notice also applies to personal information processed through on-premises hosted services provided by Neuroscale, deployed within your organization’s infrastructure. Data processed through these services remains subject to this Privacy Notice and your organization’s policies and legal requirements.

1. UPDATES TO THIS PRIVACY NOTICE

We may update this Privacy Notice periodically to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make updates, we will post the revised Privacy Notice on our Sites, and where appropriate, notify you through additional communication channels.

2. PERSONAL INFORMATION THAT WE COLLECT

The types of personal information we collect depend on how you interact with us, the Neuroscale Services, and the requirements of applicable law.

A. Personal Information You Provide to Us Directly: We collect personal information you choose to provide when interacting with the Neuroscale Services.

i. Account Information: When you create an account with the Neuroscale Services, we collect information associated with your account, including your email address, phone number, username, and any additional information required to set up or maintain your account.

ii. User Content: We may collect personal information contained in any content that you upload to the Neuroscale Services, including job descriptions, resumes, and other files.

iii. Your Communications with Us. If you communicate with us, such as through email or via social media, we may collect personal information such as your name, contact details, and the contents of your messages.

iv. Branding Information. You may provide optional branding elements, such as your organization’s name, website, logo, avatar images, and associated emails, which we may store to personalize your experience with the Neuroscale Services.

B. Personal Information We Collect Automatically: When you interact with the Neuroscale Services, we may automatically collect certain information to improve your experience and the functionality of our services.

i. Log Data: We collect information that your browser or device automatically sends when you use the Neuroscale Services, including your IP address, device type, and browser settings.


ii. Usage Information. When you use the Neuroscale Services, we collect certain information about your interaction with the Neuroscale Services, such as your Internet protocol (IP) address (which can be used to derive your general location), user settings, cookie identifiers, mobile carrier, other unique identifiers, browser or device information, and Internet service provider (ISP). We may also collect personal information about your use of the Neuroscale Services, such as the features you use, the frequency and duration of your activities, and other similar information.

iii. Cookies and Similar Technologies: We use cookies and other similar technologies to improve and personalize your experience with the Neuroscale Services. You can manage or block cookies via your browser settings.

C. Personal Information We Collect from Other Sources



i. Third Parties: We also collect information from other sources, like information that is publicly available on the internet, to develop the models that power our Services.

3. HOW WE USE PERSONAL INFORMATION

We collect and use personal data for a variety of purposes in order to provide and improve the Neuroscale Services. By using our platform, you consent to the collection and use of personal information in the manner outlined below.

A. Provide Our Services



We use personal information to:



 i. Enforce our agreements and policies.

ii. Provide and operate the Neuroscale Services, including processing user-submitted data, such as resumes and job candidate profiles, to deliver AI-driven analysis and insights. This information is processed by our on-premises AI, and any submitted User Content as defined above that is processed on behalf of your account or organization will be isolated from other users or organizations.

iii. Respond to support requests and communications related to your account or activities on the platform.

iv. Analyze and improve the performance of the Neuroscale Services, including developing new features and optimizing existing functionality to better meet user needs.

B. Communication and Notifications

We may use your personal data to:

i. Communicate with you about updates, changes, or improvements to the Neuroscale Services.

ii. Send notifications related to your use of the platform, including any security alerts, policy updates, or relevant news.

C. Security and Fraud Prevention

We may use personal information to:

i. Detect, prevent, and address fraudulent or illegal activities on the platform.

ii. Protect the security of our systems, services, and your personal data.

iii. Ensure compliance with legal obligations and protect the rights, privacy, safety, or property of our users.

iv. Enforcing our agreements and policies; and carrying out activities that are required to comply with our legal obligations.

D. Aggregated and De-identified Data
We may aggregate or de-identify your personal information to:

i. Improve and develop the Neuroscale Services.

ii. Conduct research and perform analytics without the risk of identifying individual users.

iii. De-identified information will be retained in its non-identifiable form, and we will not attempt to re-identify the data unless required by law.

E. Content Use: We may use the content you submit, such as resumes and job profiles, to improve and train our AI models, which power the Neuroscale Services. If you wish to opt-out of having your content used for model training, please refer to our instructions on how to manage this preference.

F. Marketing: We may use personal information to send marketing communications related to the Neuroscale Services, including information on new features, updates, or promotional offers.
If you do not wish to receive marketing communications, you may opt-out at any time by contacting us.

G. With Your Consent: We may use personal information for purposes that are explicitly disclosed to you at the time of collection, with your clear consent, or as otherwise allowed by applicable law.

4. DISCLOSURE OF PERSONAL INFORMATION



We may disclose personal information to third parties for specific business purposes related to providing Neuroscale Services, as detailed below.

A. Sharing to Third-Party Services: To improve the performance and functionality of the Neuroscale Services, we may securely transmit and process user data through trusted third-party service providers. These providers assist with various aspects of our service, including cloud computing resources and hosting services, to enhance the user experience and ensure the reliability and efficiency of our platform. While we primarily rely on our on-premises AI hardware infrastructure, we may engage third-party providers during periods of high demand, infrastructure maintenance, or other scenarios where additional support is necessary for the following purposes:

i. Data Processing. User data may be transmitted to and processed by third-party providers who assist with our computing and hosting infrastructure, including the use of cloud-based GPU resources to deliver Neuroscale Services.

ii. Data Security. We prioritize data security by implementing robust measures, such as encryption and secure transmission protocols, to ensure user data is protected during processing and storage.

iii. Service Optimization. The third-party services we use are integral to our ongoing efforts to improve the performance and scalability of Neuroscale Services. These services help us optimize resources and meet user demands effectively.

B. Sharing to Government Authorities or Other Third Parties:
We may share your Personal Data, including information about your interaction with our Services, with government authorities, industry peers, or other third parties in compliance with the law (i) if required to do so to comply with a legal obligation, or in the good faith belief that such action is necessary to comply with a legal obligation, (ii) to protect and defend our rights or property, (iii) if we determine, in our sole discretion, that there is a violation of our terms, policies, or the law; (iv) to detect or prevent fraud or other illegal activity; (v) to protect the safety, security, and integrity of our products, employees, users, or the public, or (vi) to protect against legal liability.

C. Sharing to Provide the Neuroscale Services

The categories of third parties with whom we may share personal information are described below.

i. Service Providers. We may share personal information with our third-party service providers and vendors. This includes service providers and vendors that provide us with IT support, hosting, payment processing, customer service, and related services.

ii. Business Partners. We may share your personal information with our business partners to provide you with a product or service you have requested. We may also share your personal information with business partners with whom we jointly offer products or services.

D. Sharing to Third-Party Websites and Services
While Neuroscale Services operate primarily on our on-premises infrastructure, our platform may integrate with third-party HR systems. In such cases:
i. Data transfers are conducted through secure, encrypted channels.
ii. Third-party systems are governed by their own privacy policies.
iii. Users are encouraged to review the privacy practices of any integrated third-party services.

Additionally, Neuroscale website(s) may contain links to websites operated by third parties. If you access a third-party website through our website(s), personal information may be collected by that third party website. Neuroscale does not make any representations or warranties regarding the privacy practices of any third-party provider or website, and we are not responsible for the privacy policies or the content of any third-party provider or website. Third party providers / websites are solely responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.

E. Sharing to Protect Us or Others
We may access, preserve, and disclose any information we store if we, in good faith, believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) protect your, our, or others’ rights, property, or safety; (iii) enforce our policies or contracts; (iv) collect amounts owed to us; or (v) assist with an investigation or prosecution of suspected or actual illegal activity.

F. Sharing in the Event of Merger, Sale, or Other Asset Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, transition of service to another provider, or other similar corporate transaction (collectively, a “Transaction”), your Personal Data may be disclosed in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.

  • Vendors, service providers, and affiliates to process in accordance with our instructions

  • Government authorities or other third parties for the legal reasons described above

  • Parties involved in Transactions

  • Business account administrators for the reasons described above

  • Other users and third parties you interact or share information with


6. RETENTION OF PERSONAL INFORMATION
We keep the personal information we collect for as long as you use the Neuroscale Services, or as necessary to fulfill the purpose(s) for which we collected it. There are also other reasons why we may keep personal information. They may include, but are not limited to, providing the Neuroscale Services, resolving disputes, establishing legal defenses, conducting audits, pursuing legitimate business purposes, enforcing our agreements, and complying with applicable laws. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, the impact on the Neuroscale Services we provide to you if we delete some personal information from or about you, mandatory retention periods provided by law, and any relevant statute of limitations.

7. YOUR PRIVACY CHOICES AND RIGHTS

A. Your Privacy Choices. The privacy choices you have about your personal information are determined by applicable law and are described below.

i. Email Communications. If you receive a marketing email from us, you may opt out by using the unsubscribe link at the bottom of such email. You will continue to receive transaction-related, non-promotional emails related to the Neuroscale Services. You will not be opted out of those communications.

ii. “Do Not Track.” Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we currently do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers, as there is no consistent industry standard for compliance.
Your Privacy Rights. Depending on what laws apply to your personal information, you may have the right to:

iii. Request Access to and Portability of Your Personal Information, including: (i) obtaining access to or a copy of your personal information; and (ii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine-readable format (also known as the “right of data portability”);

iv. Request Correction of your personal information where it is inaccurate, incomplete, or outdated. In some cases, we may provide self-service tools that enable you to update your personal information;

v. Request Deletion, Anonymization or Blocking of personal information including when processing is based on your consent, or when processing is unnecessary, excessive or noncompliant (also known as the “right to be forgotten”).

vi. Request to Opt-Out of Certain Processing Activities if we engage in certain data processing activities that give you a right of opt-out under applicable privacy laws;

vii. Request Restriction of or Object to our processing of your personal information;

viii. Withdraw your Consent to our processing of your personal information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.

ix. Be Informed about third parties with which your personal information has been shared;

x. Request the Review of Decisions Taken Exclusively Based on Automated Processing if these decisions could affect your rights under applicable data protection laws.

Please contact us using the information below if you would like to exercise any of these rights. We will process your requests in accordance with applicable laws. Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. Some laws may allow you to appeal our decision if we decline to process your request. If applicable laws grant you an appeal right, you may send us your appeal using the contact information below.

If your personal information is subject to the applicable data protection laws of Brazil, the European Economic Area, Switzerland, or the United Kingdom, and you believe our processing of your personal information violates applicable law, you have the right to lodge a complaint with the competent supervisory authority.

  1. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

We may transfer, process, and store all personal information we collect anywhere in the world. Some countries may have data protection laws that are different from the laws where you live.

If we transfer personal information from the European Economic Area, Switzerland, and/or the United Kingdom to a country that does not provide an adequate level of protection under applicable data protection laws, we will do so based on safeguards such as the European Commission-approved or UK Government-approved Standard Contractual Clauses, or otherwise in accordance with applicable data protection laws.

9. SUPPLEMENTAL NOTICE FOR CERTAIN JURISDICTIONS

A. Supplemental Notice for EU/UK GDPR

This Supplemental Notice for EU/UK GDPR only applies to our processing of personal information that is subject to the EU or UK GDPR. Personal information means any information relating to an identified or identifiable individual. If you do not provide your personal information when requested, you may not be able to use our Neuroscale Services if that personal information is necessary to provide you with our Neuroscale Services or if we are legally required to collect it.

We process personal information when we have a valid legal basis, including as set forth below:

  • Performance of a Contract: Neuroscale may need to process your personal information where required to perform our contract with you, namely the Terms of Service, and for the purposes described in Section 3 of this Privacy Notice.



  • Legitimate Interest: Neuroscale may process your personal information where we or a third party have a legitimate interest, including the purposes in Section 4 of this Privacy Notice. We only rely on our or a third party’s legitimate interest to process your personal information where these interests are not overridden by your interests or fundamental rights and freedoms.



  • Consent: In some cases, Neuroscale may also rely on your consent to process your personal information.



  • Compliance with our Legal Obligations: Neuroscale may process your personal information to comply with our legal obligations. For example, we may process your personal information to comply with tax, labor, and accounting obligations.

10. SECURITY

We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as our Services are hosted electronically, we can make no guarantees as to the security or privacy of your information.

11. CHILDREN’S PERSONAL INFORMATION

The Neuroscale Services are not directed to children under 13 (or other age as required by local law outside of the United States). We do not knowingly collect personal information from children.
